Avenal Recalled Members Served Ex Parte

AVENAL, CA (June 25, 2026) — Residents and Taxpayers of the City of Avenal served City Councilmembers who have refused to leave office today with a Superior Court Ex Parte Notice indicating on Monday June 29, 2026, residents will petition the Kings County Superior Court for a temporary restraining order to prevent the recalled Councilmembers from continuing to spend tax dollars unlawfully.
On April 28, 2026, the recall election was held in the City of Avenal. On May 28, 2026, it was certified with nearly 80% of voters in Avenal voting out 4 members of the City Council.
Pursuant to Government Code 36503.5, since April 28, 2026, the Councilmembers subject to the recall have not been authorized to expend or participate in any activity that would expend public funds. Pursuant to Elections Code 11382, on May 28, 2026, when the election was certificated, the recalled Councilmembers should have immediately left office.
Residents and Taxpayers have petitioned the court for a writ of mandamus, for a 526(a) civil restraining order, declarative relief, and injunctive relief to prevent the recalled Councilmembers from continuing to spend tax dollars unlawfully. On Monday the Court will hear residents request for a temporary restraining order to be in place pending further litigation of the writ of mandamus and Quo Warranto filing.
